The present Terms of Use and Purchase Conditions (hereinafter, "Conditions") establish the terms governing the use of this website (www.syperlas.com) and the purchase of products on it.
Please read these Terms carefully, as well as our General Privacy Policy and Cookie Policy, both available on the website itself. These Terms may be modified, so it is your responsibility to read them periodically in order to be aware of those that are in effect at the time of your purchase. 1. INTRODUCTION
We inform you that BELMAR GLOBAL S.L. is the entity responsible for centralizing the commercialization of SY Perlas products. Thus, these Terms of Use and Purchase Conditions apply to the relationship between BELMAR GLOBAL S.L., (hereinafter, “SY Perlas” or the “Company”) and you (hereinafter, the “Client”), regarding all transactions you carry out on the website www.syperlas.com (en adelante, “Online Store”).
BELMAR GLOBAL S.L., is a commercial entity of Spanish nationality, with its registered office at Calle Sagunto, 4, ZIP Code 28290 Madrid (Spain), and Tax ID: B-88595541.
2. CUSTOMER DATA AND COMMITMENT
The information or personal data that the Customer provides to us will be processed in accordance with the provisions of SY Perlas' General Privacy Policy, as well as the specific privacy policies of each web form.
When using this website, the Client consents to the processing of their data and declares that it is truthful and corresponds to reality. Therefore, the Client agrees to:
- Use this website only to make legally valid inquiries or orders;
- Do not place any false or fraudulent orders. In the event of any indications of falsity or fraud, SY Perlas is authorized to cancel the order and inform the relevant authorities. Likewise, SY Perlas assumes no responsibility for any damages and/or expenses that may arise from this.
- Provide SY Perlas with your email address, postal address, and/or other contact details truthfully and accurately. Likewise, the Client agrees that SY Perlas may use this information to contact them, if necessary.
- Do not misuse this website by intentionally introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or material. The Client shall not attempt to gain unauthorized access to this website, the server on which the website is hosted, or any server, computer, or database connected to our website. Failure to comply with this clause may result in violations punishable under applicable law.
The Client declares to be over 18 (eighteen) years old and to have the legal capacity to enter into contracts. In this regard, SY Perlas may verify compliance with this requirement by any means it deems appropriate.
3. AVAILABILITY OF THE SERVICE AND SY PERLAS PRODUCTS
The products offered on this website are available for the European territory (excluding Ceuta, Melilla, and the Canary Islands, as well as P.O. boxes). If the Customer requests shipment outside the aforementioned territory, SY Perlas reserves the right to refuse and/or cancel the order.
All orders for SY Perlas products are subject to availability. In case of supply difficulties or out of stock situations, SY Perlas will notify the Customer by email and refund any amount that may have been paid.
4. ORDERS
How are orders placed?
To place an order, the Customer must follow the online purchase procedure and click the “CONFIRM ORDER” button. Subsequently, the Customer will receive an email acknowledging receipt of their order (“Order Confirmation”) within 24 hours of placing it. The Customer will also be informed via email that the order is being shipped (“Shipping Confirmation”). Additionally, the Customer can check the status of their order in “My Account” or by calling Customer Service.
In case the Customer has made a mistake when submitting their data, they may modify it in the "My Account" section; this data will apply to future purchases. If the error concerns the current order, the Customer must contact Customer Service.
How is shipping and delivery carried out?
At the moment the Customer makes the payment, SY Perlas will ask them to choose the shipping method in order to carry out the delivery of their order. Shipping costs will vary depending on the chosen shipping method, being automatically calculated during the payment process, and before completing the order.
Orders and payment confirmations received after 4:00 PM (local time) will be processed on the next business day.
We offer the following shipping methods:
- Standard (3-5 business days) - €2.99. The delivery time for the order is 3 to 5 full business days, starting from the date the order is placed and the corresponding payment is made.
- Express (2 business days) - €5.99. The order will be delivered the next business day if placed before 4:00 PM the previous day, or within two business days for orders placed after 4:00 PM.
*The prices shown only apply to shipments within the peninsula.
*Due to the high volume of orders during campaign periods (Black Friday, Christmas, etc.), delivery times may be delayed.
In case there are circumstances arising from the customization of the products, or unforeseen or extraordinary circumstances occur, SY Perlas informs you that delivery times may be subject to variations.
If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date, or the possibility to cancel the order with a full refund of the price paid.
For the purposes of these Terms and Conditions, "delivery" or that the order has been "delivered" shall be understood to have occurred at the moment when the Customer, or a third party indicated by them, takes physical possession of the products, which will be evidenced by the signature of receipt of the order at the agreed delivery address.
In case of inability to make the delivery of the order, it will be the user who will arrange the new delivery with the transport company.
Is it possible to check the order status and order history?
If the Customer has their own account on www.syperlas.com, they can track their orders by visiting "My Account" and clicking on "View my orders." There, the Customer will be able to see their order history as well as the status of each order.
In case the Customer is not registered and does not have access to the "My Account" section, they can contact SY Perlas Customer Service directly to inquire about the status of their order.
Can SY Perlas cancel an order?
SY Perlas reserves the right to cancel any order (even if it has been previously accepted), not being responsible for any damage and/or expense, in the following cases:
- When an unintentional error has occurred in the online store; for example, a payment or stock error;
- When there are reasons to believe that the Customer is a minor or that the credit card to be used does not meet the requirements described in these Conditions;
- When the payment information provided by the Customer is incorrect or unverifiable.
- When the shipping address provided by the Customer is outside the territory, or the order cannot be delivered to the address provided by the Customer.
In the event that any of these assumptions are identified, SY Perlas will duly notify you via email, in order to resolve the issue before taking any action.
5. PRODUCT NON-CONFORMITY
Once the order is received, it is recommended that the Customer checks its condition and, if any defect or discrepancy is identified, they may choose to (i) return the product and have SY Perlas refund the corresponding purchase price, or (ii) replace the product with a new one in good condition, at no additional charge.
6. RETURN AND/OR EXCHANGE POLICY
i. Returns and exchanges
If for any reason the Customer is not satisfied with the purchased product in www.syperlas.com, you have up to 31 days to return it. During special times like Christmas, this period may be extended.
SY Perlas will proceed to refund the full amount of the product price using the same payment method used by the Customer for the initial transaction. The refund will be made within 14 calendar days following the receipt of the merchandise at SY Perlas' warehouses. Shipping and return costs, if applicable, will not be refunded. Shipping costs will only be refunded if SY Perlas has delivered a different product by mistake or one with a defect.
The method that SY Perlas establishes for the returns of its products is:
A carrier can pick up the product to be returned at the address chosen by the Customer (applicable exclusively within mainland Spain and the Balearic Islands. The Canary Islands, Ceuta, and Melilla are excluded).
The items to be returned must be delivered with their corresponding delivery note and the certificate of authenticity. Likewise, if the Customer chooses this option, SY Perlas recommends keeping the courier receipt as proof of the return made.
ii. Right of withdrawal
The Customer has the right to withdraw from this contract within a period of 14 (fourteen) calendar days without any need for justification.
To exercise the right of withdrawal, the Customer must notify SY Perlas of the decision to withdraw from the contract through an unequivocal statement and by the following means:

Consequences of withdrawal
In the event of withdrawal, SY Perlas will refund the Customer all payments received after the purchase, including shipping costs (with the exception of additional costs resulting from the Customer's choice of a delivery method different from the least expensive ordinary delivery method we offer), without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract.
SY Perlas will proceed to make said refund using the same payment method used by the Customer for the initial transaction.
SY Perlas may withhold the refund until the products have been received, or until proof of their return has been provided.
The Customer must return or deliver the goods directly without undue delay and, in any case, no later than 14 calendar days from the date on which they inform us of their decision to withdraw from the contract.

Such return will be made under the responsibility and expense of the buyer, attaching the purchase receipt and the corresponding certificate of authenticity. The item must be in perfect condition and in its original packaging.
In the event that you exercise the right of withdrawal, you will only be responsible for any decrease in the value of the products resulting from handling them in a way other than what is necessary to establish their nature, characteristics, or functioning.

7. CHECKOUT AS GUEST
The SY Perlas website also allows purchases through the guest checkout feature. In this purchase mode, only the essential information necessary to process the order will be requested from the Customer.
Once the purchase process is completed, the Customer will be offered the option to register as a user or continue as an unregistered user.
8. PRICES AND TAXES
The prices of the products displayed on the website are those applicable at the time of purchase. Prices may be subject to change without prior notice, but will not affect orders that have already been accepted.
All product prices, shipping costs, and other services include VAT. Shipping costs are added per order. SY Perlas will always inform you of the total price, including all taxes and other costs such as fees and possible delivery charges.
The Customer expressly authorizes SY Perlas to issue the invoice in electronic format, although they may indicate at any time their preference to receive a paper invoice, in which case, we will issue and send the invoice in that format.

During the purchase process, the Customer's credit card identification number (CVV) is required. The CVV is a 3 or 4 digit numeric value that provides an encryption control of the information recorded on the card. This security feature is designed to protect the Customer against fraud. Your CVV will not be stored in our systems, and the Customer must provide the number each time a purchase is made on www.syperlas.com.
When the purchase request and the Customer's data have been verified, and the purchased products have left the SY Perlas warehouse for shipment, the charge for the price will be made effective from your account.
When the Customer clicks on "AUTHORIZE PAYMENT," they confirm that the credit card is theirs or that they are the legitimate holder. Credit cards will be subject to checks and authorizations by the issuing entity, but if such entity does not authorize the payment, SY Perlas will not be responsible for any delay or failure in delivery and will not be able to formalize any contract with the Customer.
10. COUNTERFEIT ALERT
SY Perlas products are available exclusively on the SY Perlas website (www.syperlas.com), and in the SY Perlas Amazon store. Buyers should be cautious of products that may be sold through unauthorized channels. To avoid confusion, when purchasing from any authorized establishment, a certificate of authenticity is issued, certifying the legitimacy of the product and its validity regarding any production imperfections.
Since its founding in 2016, SY Perlas has strived to ensure high quality standards in all its products. All SY Perlas products bear the noble metals hallmark: 18 kt Gold (750/000) and Sterling Silver (925/000).

12. COMPANY LIABILITY
SY Perlas guarantees the quality of the service contracted through the Online Store.
All rights granted to consumers and users by the laws in force are guaranteed.
The breach of any of these Terms and Conditions may result in the return of the products or the cancellation of the services purchased by the Customer.
13. WARRANTIES
SY Perlas will respond to the Customer for any non-conformity claims regarding deliveries within a period of two years, as established by current regulations. The warranty excludes defects caused by use or improper use, as well as, in general, all those excluded by current legislation.
Unless expressly stated otherwise in these Terms, SY Perlas' liability in relation to any product purchased on the website shall be strictly limited to the purchase price of said product.
All descriptions, product photographs, information, and materials appearing on this website are provided "as is" without express or implied warranties except those legally established. Some products may appear slightly larger or smaller than their actual size due to screen settings and photographic technique. Other items may be shown larger than their actual size to clearly display details; or smaller than their actual size to show the entire item. In this regard, if the Customer contracts as a consumer and user, SY Perlas is obliged to deliver items that conform to the contract, being responsible to the Customer for any non-conformity existing at the time of product delivery. Likewise, the color tones in the product photographs on the online store may be altered by your monitor's resolution and may differ from the actual colors.
The products we sell may have some variations due to the inherent characteristics of the natural materials used in their manufacture. These characteristics, such as variations in colors, sizes, textures, among others, will not be considered defects or flaws.
SY Perlas will not be responsible for any damage or loss resulting from a denial of service attack, virus, or any other technologically harmful or damaging program or material that may affect the Client's computer, hardware, data, or materials as a consequence of using this website or downloading content from it or, where applicable, those to which it redirects.
14. FORCE MAJEURE
SY Perlas will not be responsible for any non-compliance or delay in fulfilling any of the assumed obligations when it is due to events beyond reasonable control ("Force Majeure Cause").
Force Majeure Causes shall include any act, event, failure to act, omission, or accident beyond our reasonable control and, among others, the following:
- Strikes, lockouts, or other protest measures.
- Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
- Impossibility of using trains, ships, planes, motor vehicles, or other means of transportation, public or private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions from any government or public authority.
It will be understood that the obligations will be suspended during the period in which the "Force Majeure Cause" continues, and SY Perlas will have an extension of the term to fulfill said obligations for a period of time equal to the duration of the "Force Majeure Cause." SY Perlas will use all reasonable means to end the "Force Majeure Cause," or to find a solution that allows it to fulfill its obligations despite the "Force Majeure Cause."
15. INDUSTRIAL AND INTELLECTUAL PROPERTY
The Client acknowledges and agrees that all copyright, trademarks, and other industrial and intellectual property rights over all the content on the website belong to SY Perlas, or to those who have granted SY Perlas a license for their use.
16. PREVENTION OF MONEY LAUNDERING AND TERRORISM FINANCING
SY Perlas, due to its professional activity of marketing jewelry, stones, or precious metals, is a subject obligated by Law 10/2010 of April 28, on the prevention of money laundering and terrorist financing.
This means that, among other obligations applicable to this condition, SY Perlas must identify and keep a copy of the official identity document (DNI, Passport, etc.) of any customer who makes a purchase equal to or greater than €1,000 in jewelry products. This is due to the provisions established in the current regulations on the matter.
Thus, the Customer is aware of this legal obligation and agrees to send, upon request by SY Perlas, a copy of the valid identity document to comply with it within a maximum period of ONE MONTH from the date of purchase.
17. WRITTEN COMMUNICATIONS
The applicable regulations require that part of the information or communications sent by SY Perlas be in writing. The Client, by using this website, consents that most of these communications with SY Perlas be electronic.
Thus, SY Perlas will contact the Customer by email or by posting notices on the website itself. For contractual purposes, the Customer agrees to use this electronic means of communication and acknowledges compliance with the legal requirement of being in writing.
18. ASSIGNMENT OF RIGHTS AND OBLIGATIONS
The contract is binding for both the Client and SY Perlas, as well as for their respective successors, assignees, and beneficiaries. The Client may not assign, transfer, encumber, or otherwise transfer a contract or any of the rights or obligations arising from it without having obtained prior written consent from SY Perlas.
We may assign, transfer, record, subcontract, or otherwise transfer a contract or any of the rights or obligations arising from it, at any time during its term, without affecting the Client's rights in any way.
19. WAIVER
The lack of requirement by SY Perlas regarding the strict compliance with any of the obligations assumed by the Client, under a contract or these Conditions, or the lack of exercise by SY Perlas of the rights or actions that may correspond to it, under said contract or the Conditions, shall not constitute a waiver or limitation of such rights or actions, nor shall it exempt the Client from fulfilling such obligations.
None of SY Perlas' waivers of a specific right or action shall constitute a waiver of other rights or actions arising from a contract or the Terms.
No waiver by SY Perlas of any of these Conditions or of the rights or actions arising from a contract shall be effective unless it is expressly stated to be a waiver, and is formalized and communicated to the Customer in writing in accordance with the provisions above.
20. ENTIRE AGREEMENT AND PARTIAL INVALIDITY
These Terms, and any document expressly referenced therein, constitute the entire agreement between the Customer and SY Perlas, in relation to their subject matter. They also replace any other pact, agreement, or promise previously agreed upon between the Customer and SY Perlas, whether verbal or written.
The Client and SY Perlas acknowledge having consented to the execution of a contract without relying on any statement or promise made by the other party or that could be inferred from any statement or writing in the negotiations conducted by both parties prior to it, except for what is expressly stated in these Terms and Conditions.
Neither the Client nor SY Perlas shall have any action against any uncertain statement made by the other party, verbal or written, prior to the date of a contract (unless such uncertain statement was made fraudulently) and the only action available to the other party shall be for breach of contract, in accordance with the provisions of these Conditions.
If any of these Terms or any provision of a contract is declared null and void by a final ruling issued by a competent authority, the remaining terms and conditions shall remain in effect, unaffected by such declaration of nullity.
21. MODIFICATION OF CONDITIONS
SY Perlas reserves the right to review and modify these Terms at any time.
The Customer will be subject to the policies and Conditions in effect at the time they use this website or place each order.
22. LANGUAGE, APPLICABLE LAW AND JURISDICTION
The language in which the contract between SY Perlas and the Client will be perfected is Spanish.
The use of the SY Perlas website and purchase contracts for products through said website will be governed by Spanish law.
Any dispute arising from or related to the use of the website or said contracts shall be subject to the non-exclusive jurisdiction of the courts and tribunals of the Client's domicile.
