These Conditions may be amended, so it is your responsibility to read them periodically in order to be aware of those in force at the time of making your purchase. We inform you that BELMAR GLOBAL S.L. is the entity responsible for centralizing the marketing of SY Perlas products. Thus, these Terms of Use and Purchase Conditions apply to the relationship between BELMAR GLOBAL S.L. (hereinafter, "SY Perlas" or the "Company") and you (hereinafter, the "Customer") with respect to all transactions you carry out on the website www.syperlas.com (hereinafter, the "Online Store"). BELMAR GLOBAL S.L. is a commercial entity of Spanish nationality, with registered office at Calle Sagunto, 4, CP 28290 Madrid (Spain), and CIF: B-88595541.
2. CUSTOMER DATA AND COMMITMENT
The information or personal data that the Customer provides to us will be processed in accordance with SY Perlas’ General Privacy Policy. By using this website, the Customer consents to the processing of their data and declares that it is truthful. Therefore, the Customer undertakes to:

The Customer declares they are over 18 (eighteen) years of age and have the legal capacity to enter into contracts.
3. SERVICE AVAILABILITY
The products offered on this website are available for shipping to Spain, the European Union and the rest of the world, according to the areas specified in our Shipping Policy. SY Perlas reserves the right not to accept the order if the shipping address is not within our logistics operating zones.
4. ORDERS AND SHIPPING
How to place orders? To place an order, the Customer must follow the online purchase procedure and click the “CONFIRM ORDER” button. The contract will be deemed formalized when the Customer receives the "Order Confirmation" email.
Shipping, Costs and Timeframes Shipping costs and delivery times will vary depending on the destination and the order amount. For up-to-date and binding details on rates and transit times, please consult our [Shipping Policy], the terms of which are understood to be reproduced here and integrated as part of this contract.

Delays: If for any reason we are unable to meet the delivery date due to reasons attributable to SY Perlas, we will inform you and give you the option to proceed with the purchase with a new date or cancel the order with a full refund.

Delivery: “Delivery” shall be deemed to have occurred when the Customer or a third party indicated by the Customer acquires material possession of the products.
5. PRODUCT NON-CONFORMITY
Once the order has been received, it is advisable for the Customer to check its condition and, if any defect is identified, to inform us immediately so that we can proceed with a solution (exchange or return).
6. EXCHANGE AND RETURN POLICY
If for any reason the Customer is not satisfied with the product purchased, exchange and return options are available. The specific conditions, time limits, return costs and cases of free returns are detailed in our [Exchange and Return Policy].
Statutory Right of Withdrawal The Customer has the right to withdraw from this contract within 14 (fourteen) calendar days without giving any reason. To exercise this right, you must notify us of your decision by means of an unambiguous statement by writing to team@syperlas.com.
Exceptions to the Right of Withdrawal In accordance with applicable regulations, the right of withdrawal shall not apply to contracts relating to:

The supply of goods made to the consumer’s and user’s specifications or clearly personalized (e.g., jewelry with engraved initials, dates, or special sizes requested outside the catalog).
Effects of withdrawal In the event of withdrawal, we will refund all payments received, including delivery costs (except for additional costs if you chose an express method different from the standard one). The Customer must return the goods to: BELMAR GLOBAL S.L., Calle Sagunto 4, 28290 Las Rozas de Madrid, Spain.
7. GUEST CHECKOUT
The website allows guest checkout, requesting only essential data. Upon completion, the option to register as a user will be offered.
8. PRICES AND TAXES
The prices shown on the website include the VAT applicable to sales within the European Union.

International Orders (Outside the EU): The prices shown do not include Spanish VAT. However, the order may be subject to local taxes, duties and customs handling fees in the destination country, which shall be the sole responsibility of the Customer.
9. PAYMENT METHODS
Accepted payment methods are: Cards (Visa, MasterCard, Amex, Maestro), PayPal, ApplePay, Google Pay, Bank Transfer and Cash on Delivery (the latter valid only for Spain and Portugal). By clicking “AUTHORIZE PAYMENT,” the Customer confirms that the card is theirs. Cards are subject to checks by the issuing entity.
10. COUNTERFEIT ALERT
SY Perlas products are available exclusively on the official website (www.syperlas.com). SY Perlas does not guarantee the authenticity of products purchased through unauthorized channels. All our jewelry includes a certificate of authenticity and complies with precious metal hallmarks: 18 kt Gold (750/000) and Sterling Silver (925/000).

12. COMPANY LIABILITY
SY Perlas guarantees the quality of the service contracted through the Online Store. All rights granted to consumers and users by applicable laws are guaranteed.
13. WARRANTIES
SY Perlas is liable for any lack of conformity that becomes apparent within three years from delivery, in accordance with current regulations.

Nature of Pearls: The Customer understands that cultured pearls are natural organic gems. Slight variations in color, hue, shape or texture compared to photographs are not considered non-conformities, but rather characteristics inherent to their natural origin.

Exclusions: The warranty excludes damage caused by improper use, natural wear, or physical or accidental abuse.
14. FORCE MAJEURE
SY Perlas shall not be liable for any failure or delay due to events beyond our reasonable control ("Force Majeure Event"), including strikes, natural disasters, or transportation issues. Obligations shall be deemed suspended during such period.
15. INDUSTRIAL AND INTELLECTUAL PROPERTY
The Customer acknowledges and agrees that all copyright, trademarks and other industrial and intellectual property rights over all website content belong to SY Perlas, or to those who have granted SY Perlas a license for their use.
16. ANTI-MONEY LAUNDERING AND COUNTER-TERRORIST FINANCING
Due to its professional marketing of jewelry, gemstones or precious metals, SY Perlas is an obliged entity under Law 10/2010 on the prevention of money laundering. SY Perlas must identify and keep a copy of the reliable identity document of any customer who makes a purchase equal to or greater than 1.000€ in jewelry products. The Customer undertakes to send such copy within a maximum period of one month if requested.
17. WRITTEN COMMUNICATIONS
Applicable regulations require that part of the information or communications sent by SY Perlas be in writing. By using this website, the Customer agrees that most of such communications with SY Perlas will be electronic (email or notices on the website). For contractual purposes, the Customer consents to the use of this electronic means of communication and acknowledges compliance with the legal requirement of being in writing.
18. ASSIGNMENT OF RIGHTS AND OBLIGATIONS
The contract is binding on both the Customer and SY Perlas, as well as their respective successors and assignees. The Customer may not transfer, assign or encumber a contract without SY Perlas’ prior consent. SY Perlas may transfer, assign, encumber or subcontract a contract at any time during its term, without affecting the Customer’s rights.
19. WAIVER
The failure of SY Perlas to require strict performance by the Customer of any obligation, or the failure to exercise rights or actions, shall not constitute a waiver or limitation of such rights, nor shall it release the Customer from compliance with such obligations. No waiver shall be effective unless expressly set forth in writing.
20. ENTIRE AGREEMENT AND PARTIAL NULLITY
These Conditions constitute the entire agreement between the Customer and SY Perlas, superseding any prior agreement. If any of these Conditions is declared null and void by final decision, the remaining terms and conditions shall remain in force, unaffected by such declaration of nullity.
21. AMENDMENT OF CONDITIONS
SY Perlas reserves the right to review and amend these Conditions at any time. The Customer will be subject to the policies and Conditions in force at the time they use this website or place each order.
22. LANGUAGE, APPLICABLE LAW AND JURISDICTION
The language of the contract is Spanish. The use of the website and purchase contracts shall be governed by Spanish law. Any dispute shall be submitted to the jurisdiction of the courts of the consumer’s domicile.
